A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal detention.

In her order, the judge noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
